‘A woman cannot be forced to complete her pregnancy’, a big decision of the Supreme Court

New Delhi. The Supreme Court, while giving an important decision, has clearly said that no woman, especially a minor girl, can be forced to complete her pregnancy against her will. Along with this, the court has given permission to terminate the pregnancy of 30 weeks. Let us tell you that this pregnancy was of a girl who was a minor at the time of conception. This decision was given by the bench of Supreme Court Justice BV Nagarathna and Justice Ujjal Bhuiyan. The court has ordered that the abortion procedure be performed at JJ Hospital in Mumbai with all necessary medical precautions.

The court said in its order that in this case it is necessary to first look at the rights of the minor girl. The girl is going through a difficult situation and she does not want to continue this pregnancy. The court said that the question that is not important is whether the relationship was consensual or not, but the fact is that the girl is a minor and does not want to become a mother.

The Supreme Court has said in its decision that if the interest of the mother is considered, then her own choice and right to take decisions will have to be given full importance. The court cannot force any woman, and that too a minor, to become a mother.

During the hearing, Justice Nagarathna said that this decision is not easy even for the court. On the one hand there is the unborn child, who will have a life when born, and on the other hand there is the girl’s clear wish that she does not want to continue the pregnancy. He said that when abortion can be allowed till 24 weeks, then why should it be stopped at 30 weeks just because the time is longer, when the girl clearly does not want to give birth to a child.
