Statement of former CJI DY Chandrachud in Umar Khalid case, said – bail should be given before the crime is proven.

DY Chandrachud On Umar Khalid: The Supreme Court had rejected the bail plea of Umar Khalid and Sharjeel Imam in the Delhi riots conspiracy case. About two weeks after this decision of the Supreme Court, a big statement of former Chief Justice of India DY Chandrachud has come out. He said that long jail sentences without trial weaken the process of constitutional justice.

What did former CJI DY Chandrachud say?
Former CJI DY Chandrachud attended an event in Jaipur on Sunday (January 18). In this program he said that getting bail before conviction is a right of a citizen. If any matter is related to national security then it should be investigated in depth.

‘They have the right to be heard’
Former CJI said that Umar Khalid has been in jail for five years. I am not criticizing the court. If the conditions of bail are abused then you can impose conditions. Along with this, you have to keep in mind that they have the right to be heard. In the present circumstances, early hearing is not possible, so bail should not be an exception but should be the rule.

He further said that I disposed of 21 thousand petitions during my tenure of 24 months. There are many such matters which are not thought of while criticizing the Supreme Court for granting bail in a case.

What did the Supreme Court say on bail?
The Supreme Court has considered Umar Khalid and Sharjeel Imam as the main planners in conspiring the 2020 Delhi riots.
A case was registered against Khalid-Sharjeel and other accused under Section 15 of UAPA.
Justice Arvind Kumar and Justice NV Anjaria, while hearing the petition, had granted bail to the accused Gulshifa Fatima, Meeran Haider, Shifa Ur Rehman, Mohammad Salim Khan and Shadab Ahmed.
The court had pointed out the difference between main architects and associates.
