New Delhi. The Supreme Court issued an important order on Saturday, giving the status of internet availability and its use as a fundamental right for every citizen of the country, especially children. The apex court delivered this far-reaching judgment underlining the provisions of Article 21 and Article 19(1)(a) of the Constitution of India. Along with this, the court made it clear that the protection of children and their rights to freedom do not conflict with each other, but it is necessary to maintain a balance between the two.

Right to expression and life in the digital age

The court said in its address that in the modern era, the Internet is no longer just a source of entertainment or information, but it has become an essential medium for living a dignified life and expressing one’s views. The right to expression guaranteed under the Constitution cannot be seen in isolation from digital mediums. Thus, depriving someone of internet service without valid reason would be considered a violation of the fundamental rights of a citizen.

Balancing child safety and freedom

Making a special comment in the context of children, the Supreme Court said that it is extremely important to ensure the safety of children on the Internet, but this does not at all mean that their freedom should be taken away in the name of safety. It is important to provide a safe environment to children in the digital world as well as maintain opportunities for them to learn and develop. It is the responsibility of the state and society to strike the right balance between security and freedom.
